New Prop 65 Warnings | January 19th, 2022

Preview of new California Prop 65 warnings

On 19 January 2022, Claigan Environmental Inc. (www.- claigan.com) will present a webinar on the updated proposed changes to California Proposition 65 warnings. This webinar will discuss proposed warning changes likely to go into effect in spring of 2023.

For some time, changes to the Prop 65 short form warnings have been discussed by the California Office of Environmental Health Hazard Assessment (OEHHA) including consultation on the proposed new warnings in 2020 and 2021. Based on comments from those consultations, OEHHA has proposed some additional changes and a short consultation to January 21 2022.

The new changes focus primarily on the placement and text of the short form warnings but include new options for the long form warnings. Like the original consultation, the core element is the need to declare at least one reproductive toxin (if applicable) and one carcinogen (if applicable) in the short form warning.

EU SCIP Database Goes Public | Date: October 6, 2021

Review of the good, the bad, and the ugly

On 6 October 2021, Claigan Environmental Inc. (www.- claigan.com) will present a webinar on the range of product declarations in the SCIP database. This webinar will present samples of public SCIP files ranging from the excellent, to the decent, to the ‘dumpster fires’.

All products with REACH Substances of Very High Concern (SVHC) above 0.1% w/w in any component of a product needs to be registered properly in the EU Substances of Concern in Products (SCIP) database. In September of 2021, the SCIP database opened access to the national authorities and the general public.

Global PFAS Regulation | Date: September 15, 2021

Regulation of Perfluoroalkyl substances in Products

On 15 September 2021, Claigan Environmental Inc. will present a webinar on the new global restrictions on perfluoroalkyl substances (PFAS) in products . The webinar will focus on how the new and upcoming restrictions in the US (TSCA), EU (REACH), and Canada (Canadian Prohibition).

Perfluoroalkyl substances are a complex family of chemicals used to create water proof coatings, and in the manufacturing process of fluoropolymers such as PTFE. Due to bioaccumulation and biopersistent properties, the longer chain PFAS substances are becoming restricted in products in most jurisdictions.

Under the Toxic Substances Control Act (TSCA), the US has placed notification requirements on long chain perfluoroalkyl carboxylates (LCPFAC), a subset of PFAS, in articles (physical products). At the same time, the US has proposed a new rule requiring reporting of PFAS and fluoropolymers (such as PTFE and FKM) in products.

Meanwhile, the EU has created a new restriction in LCPFAC in products under REACH – starting in February of 2023 and has an ongoing consultation to broadly restrict PFAS and perfluoropolumers. Canada is expected to release LCPFAC restriction on the Canadian Prohibition of Certain Substances this fall.

Managing New US Federally Restricted Substances | Date: May 26, 2021

TSCA 5 PBTs and SNUR on perfluoroalkyl substances

On 26 May 2021, Claigan Environmental Inc. will present a webinar on managing the new EPA restrictions for Persistent, Bioaccumulative, and Toxic (PBT) chemicals and perfluoroalkyl substances .  The webinar will focus on the substances covered under each requirement, their high risk materials, and common approaches to comply with both requirements.

In January of 2021, the US EPA issued two sets of new US federal restricted materials requirements.  Both of these requirements apply to physical products (articles).

The first was a final rule restricting five (5) PBT substances – decaBDE, 2,4,6-TTBP, PCTP, PIP 3:1, and HCBD.  This is one of the first US restricted materials requirements applicable to consumer and professional physical products (articles).  PIP, decaBDE, and PCTP, in particular, have uses in many products.

The second was a significant new use rule (SNUR) requiring importers of articles containing certain Long-Chain Perfluoroalkyl Carboxylates (LCPFAC) as a surface coating to submit a Significant New Use Notice (SNUN) to the EPA.   A common LF-PFAC is the substance PFOA.

Changes in US Restricted Materials Compliance | Date: Feb 3, 2021

Changes to Prop 65 warnings and five substance restricted under TSCA

On February 3 2020, Claigan Environmental Inc. will present a webinar on the significant changes to both California Proposition 65 and US TSCA.  Under the proposed Prop 65 changes, the generic small form warnings will be replaced by warnings that include identification of at least one chemical.  Under TSCA, in January 2021, the US EPA has banned five substances in articles.  In both cases, the deadlines are in 2022 – leaving companies with very little time to prepare.

California Proposition 65 (Prop 65) is the most heavily enforced restricted materials legislation in the world, with over 300 prosecutions per month.  Prosecutions under Prop 65 have been avoidable by providing simple generic warnings on products or packaging.  Under the proposed amendments, companies will now have to identify specific chemicals in their generic warnings.  In the first half of the webinar, Claigan will go into specific detail on the changes including practical outcomes.

Unlike the EU and California, the US, at a federal level, has had very few chemical restrictions in products.  Under the new final rules published by the EPA in January 2021, five substances will now be banned in articles.  In the second half of the webinar, Claigan will describe the restrictions, deadlines, common uses of the chemicals, and practical approaches to compliance, considering the short deadlines involved.

Meeting the SCIP deadline and plan for year two

December 9 2020, Claigan Environmental Inc. (www.claigan.com) will present on the key items of completing your SCIP database registration and planning for your 2021 SCIP work.  The principle requirement by January 5 2021 is to ensure your products containing SVHCs, their SVHC containing components, and the SVHCs contained are registered in the SCIP database.  There are lots of differences of opinions out there.  This webinar will focus on a practical plan involving being compliant on time and then looking to 2021 for refining of data as more guidance and standard practices appear.

SCIP Registration | November 10, 2020

Submitting SCIP files into IUCLID

On November 10 2020, Claigan Environmental Inc. will present on how to register SCIP dossiers in IUCLID.  This webinar will focus on dataset creation, validation, dossier export, registration upload, and gathering SCIP numbers.

Nanomaterials and EU MDR | August 26, 2020

How to handle the nanomaterials requirements of EU Medical Device Regulation.

On August 26 2020, Claigan Environmental Inc. (www.claigan.com) will present a webinar on common practices to manage the nanomaterials requirements of the EU Medical Device Regulation (MDR).  Unbeknownst to most medical device manufacturers, their product normally contains ingredients that meet the definition of a nanomaterial. This webinar will focus on the definition of nanomaterials, the requirements under EU MDR, common nanomaterials in medical devices, and common practices for EU MDR compliance for nanomaterials in medical devices.  As nanomaterials become more regulated, this webinar should also serve as an excellent basis for non-medical device manufacturers in understanding how to handle nanomaterials as they become more regulated in other products.

Most inorganic additives (colourants, stabilizers, fillers, and flame retardants) embedded in plastics meet the EU definition of a nanomaterial in their original powder form.  For many medical device manufacturers, the question is how to handle the presence of those nanomaterials in their plastics.  Claigan’s webinar will discuss the EU definition of nanomaterials, the broad requirements for nanomaterials under EU MDR, and practical options that are being adopted by medical device manufacturers.

On August 5 2020, Claigan Environmental Inc. will present a webinar on the July updates to the ECHA SCIP guidance.  This webinar will focus on the most recent guidance updates, particularly around worst case scenario reporting, distributor Simplified SCIP Notifications (SSN), and the software/format changes in August.  As part of the webinar, Claigan will be discussing the four (4) new REACH SVHCs added in June.

Every month, ECHA is providing updated guidance on submitting SCIP declarations.  Based on feedback from industry and other stakeholders, they are further refining and explaining both the database and the options for inputting data into the system.  In July, ECHA provided another set of guidance including much more detailed information on ‘worst case scenario’ and distribution Simplified SCIP Notification (SSN) requirements. The details are complicated and Claigan finds it helpful to better explain the process in simple and practical terms.

Where did they originate and is there any pattern to them?

 On 2 April 2020, Claigan Environmental Inc.  will present a webinar on the origins and commonality of global restricted materials legislation.  There are so many global restricted materials legislations – RoHS, REACH, POP, Prop 65, Canadian Prohibition, China RoHS, etc. – but is there parallels between them and is there a way to comprehensively manage them all by strategically managing a few?  This webinar will cover the range of global restricted materials legislations and discuss their common roots and overlapping substances.

How to create a SCIP declaration with partial supplier information

On 25 March 2020, Claigan Environmental Inc. will present a webinar on how to create a SCIP declaration from partial or incomplete supplier data.  The webinar will be hands on with physical examples taking participants from start to finish.
By January 5 2021, all products with a Substance of Very High Concern (SVHC) in any component above 0.1% w/w need to be entered into the SCIP (Substances of Concern in Products) database.  With the majority of complex products containing SVHCs above 0.1% w/w, this requirement will impact most importers to and manufacturers within the European Union.  Due to the high number of REACH SVHCs and the complexity of consumer products, collecting accurate and complete components data and suppliers is both time consuming and often unsuccessful.
In this webinar, Claigan will go through their approach to SCIP declarations which leverages collected supplier data but is not constrained by the missing information.  While testing is the most effective means for compliance for new products, that option is not always viable for the large of legacy products or product variations being sold by many companies.  This webinar will use processes that leverage the best of both worlds into a more practical and effective approach.

Restricted Materials In Plastics | Date: October 9th, 2019

EU SCIP Database – Information Requirements | Date: September 18, 2019

Information requirements of REACH SVHC Database

ECHA REACH SVHC Database | May 22, 2019

What is it and how to comply

On 22 May 2019, Claigan Environmental Inc. will present the proposed REACH SVHC database of the European Chemical Agency (ECHA).  The webinar will cover the known data requirements, the scope, compatibility with current REACH SVHC declarations, and practical approaches to submit data.

The new EU Waste Directive (2018/851) includes a requirement for the ECHA to create a database for hazardous substances in materials and products.  At this point in time, the hazardous substances are limited to the EU REACH (Registration, Evaluation, Authorization and Restriction of Chemicals) Regulation’s Substances of Very High Concern (SVHC).  According to the EU Waste Directive, SVHC information is required to be submitted into the database for each product by January 5, 2021.

Even though the final technical details are still in development, a prototype version is expected in 2019 with manufacturers and importers being able to enter their data in 2020.  This webinar will cover what is known to date and show practical solutions to complying with the requirements.

RoHS in 2019 | Date: April 4, 2018

New EU and China RoHS Restrictions in 2018

On 4 April 2018, Claigan Environmental Inc. will present a webinar on the new RoHS restrictions coming into effect in the EU and China in 2019.  This webinar will discuss, in practical terms – the new restrictions (EU RoHS and China RoHS), scope, compliance outputs, compliance methods, and enforcement.On March 15 2018, the first China RoHS catalog (“Announcement No. 15 of 2018 of the Ministry of Industry and Information Technology of the People’s Republic of China”)  was published adding EU RoHS-like restrictions to eleven (11) categories of electronic products starting in March of 2019.  

This is the first time that material restrictions have been added to China RoHS.  Since the original China RoHS in 2005, the legislation has allowed for future restrictions, but until 2019 – the requirements were only a hazardous substance table and label.In July 22 2019, EU RoHS (under Directive 2015/863/EU) will expand the number of covered restricted substances for the first time since its inception in 2002.  Four (4) low molecular weight phthalates (DEHP, BBP, DBP, and DIBP) are being adding to the substances restrictions.  Unlike the previous RoHS version, data for the new RoHS restrictions is not as readily available, and updated compliance strategies need to be employed.  This webinar will discuss the requirements, outputs, and compliance options for the new RoHS substances.The main topics to be covered in this webinar are –

    On 17 April 2014, Claigan Environmental Inc. will present a webinar on how to write a Conflict Minerals Report (CMR) for submission to the SEC. Companies under scope of Section 1502 of the Dodd-Frank Act are required to submit a Conflict Minerals Report to the SEC as an exhibit to their specialized disclosure report (Form SD) if they are sourcing conflict minerals from the DRC or surrounding region. Based on current Reasonable Country of Origin Inquiry (RCOI) data, virtually all affected companies with products containing circuit boards will be sourcing from the DRC or surrounding region, and will be required to submit a Conflict Minerals Report to the SEC. This webinar will explain the details and standard sections that make up a Conflict Minerals Report.This webinar will describe the process for identifying if a report is needed, the requirements under the SEC final rules and OECD Due Diligence Guidance, and the contents of the report itself.
