California SB 54 – Packaging Producer Responsibility
Under California’s SB 54, companies selling packaged goods in California must register with the state’s approved Producer Responsibility Organization (PRO). Covered producers are required to report detailed baseline and annual packaging data for each individual packaging component.
Submissions must also include a heavy metals compliance declaration and a comprehensive “Plastic Source Reduction Plan“. Hard to recycle packaging will be met with Eco-Modulated Base Fees.

California SB 343 – Recycling Labeling Justification
California’s “Truth in Recycling” legislation (SB 343) strictly prohibits placing the famous chasing arrows symbol or making recycling claims on packaging unless the material is proven to be actively recycled in the state.
Applicable to products manufactured after October 4, 2026, this law places strict liability directly on the brand owner. This will allow third parties to initiate lawsuits based on false advertising claims if your
recycling justifications rely merely on a supplier’s “say-so”.
The legislation effectively prevents brands from misleading consumers with “greenwashing” labels on items that ultimately end up in landfills.

EU PPWR
